1. Bullion Link Services:

The Services shall at all times be subject to these Terms and Conditions.

In the event of a conflict, these Terms and Conditions shall prevail.

Bullion Link (PTY) Ltd reserves the right to change or modify these Terms and Conditions at any time, with notice given through the Website or email.

2. Service Level Agreement:

The creation of an account on the Bullion Link (PTY) Ltd platform constitutes agreement to these Terms & Conditions, forming an unwritten contract between Bullion Link (Pty) Ltd and the user.

The performance of Courier Services is subject to the terms and conditions of each individual courier partner.

3. Bullion Link (PTY) Ltd Account:

Bullion Link (PTY) Ltd may suspend or terminate your account and/or withhold shipments under certain circumstances.

4. Transit Protection Benefit:

Bullion Link offers Transit Protection Benefit to Buyers for amounts under R50,000 (Fifty Thousand rand). The availability and terms of the Transit Protection Benefit should be clearly communicated in the product listing. For amounts greater than R50,000, the seller will incur an additional freight charge of 1%. The Seller will also be requested to insert a tracking device supplied by Bullion Link and must be booked in advance. The cost for shipping the device and instruction to the seller will be funded by Bullion Link. This rate is subject to future revision, and the cost is revealed during the order checkout process.

5. Delivery Time frames:

Sellers should provide estimated delivery time frames based on their chosen shipping method and location since this may have an impact on Bullion Links’s trustworthiness. Sellers should make reasonable efforts to deliver the ordered items within the specified time frame. Sellers should promptly notify Bullion Link and Buyers in case of any delays or unforeseen circumstances affecting the delivery time frame.

6. Lost or Damaged Items:

In the event that a purchased item is lost or damaged during shipping, which can be traced by means of camera footage, case filed at the South African Police, in the event of a hijack or in the event of an accident. Buyers should contact Bullion Link and the Seller immediately to initiate a notification process. Bullion Link will cooperate with the Sellers and Buyers and assist in the notification process with the relevant shipping provider or insurer. Bullion Link will refund the value of the discrepant item from a legitimate cause, after a full investigation was done, which can take up to 6 months, depending on the institute conducting the investigation. In the event where an item cannot be replaced due to the limited amount of items produced, Bullion Link will refund the value paid by the buyer only. Bullion Link, Sellers, and Buyers should resolve any disputes or disagreements regarding lost or damaged items in good faith and with mutual understanding.

7. Cancellations and Returns:

7.1. Customers have the right to return any purchases within a period of 7 (seven) calendar days from the date of receipt, except for items won on auction.

7.2. To be eligible for a return, the product must be in its original condition, unaltered, unopened, and undamaged.

7.3. Returns will not be accepted if the product has been tampered with, altered, or damaged due to customer negligence.

7.4. Sellers should clearly communicate their cancellation and return policy in the product listing, including any exceptions for auction items.

7.5. Buyers may request cancellations or returns within the specified time frame and in accordance with the Seller's policy, except for auction items.

7.6. Sellers should process cancellations or returns promptly and refund the appropriate amount to the Buyers, except for auction items.

7.7. Buyers and Sellers should honour any obligations and conditions set forth in the cancellation or return policy, except for auction items.

7.8. Items won on auction cannot be cancelled and are not returnable or refundable. The transaction for auction items is solely between the seller and the buyer, and Bullion Link acts solely as an Agent in facilitating the auction process.

7.9. Bullion Link will facilitate refunds on behalf of active sellers and buyers. Sellers will be assisted in processing refunds directly to or from the buyer. However, if the seller is blacklisted on the site, they must request the funds to be disbursed and then proceed with a direct refund to the buyer. Please note that refunds may not be immediate.

8. Courier Services:

The Bullion Link (PTY) Ltd Site provides access to Transfer-IT (PTY) Ltd Courier Services including their Transit Protection Benefit , performed by the Couriers and not by Bullion Link’s.

You must familiarize yourself with the terms and conditions of the chosen Courier for Courier Services.

9. Sale of Goods & Stores:

Bullion Link (PTY) Ltd does not directly engage in the sale of goods. Instead, it serves as a platform facilitating transactions between sellers and buyers, including auctions, and coordinates courier services for the delivery of purchased items.

10. Fees & Payment:

Shipping fees are charged by Bullion Link (PTY) Ltd to the seller’s account for Courier Services (“Shipping Fees”).

11. General Provisions relating to the Courier Services:

You must comply with all conditions and/or restrictions imposed by Couriers.

12. Warranties:

You warrant that these Terms and Conditions are binding and that you have the necessary authority to act on behalf of the entity.

13. Limitation of Liability & Indemnity:

Bullion Link (PTY) Ltd shall not be liable for certain losses or damages.

You indemnify and hold Bullion Link (PTY) Ltd harmless against any losses incurred.

14. Links to and from other Websites:

Bullion Link (PTY) Ltd is not responsible for third-party websites linked to its Site.

15. Applicable Legislation:

Compliance with laws does not waive any rights under these Terms and Conditions.

16. No Cession:

You may not assign any rights or obligations under these Terms and Conditions to third parties.

17. Severability:

If any provision is deemed illegal or unenforceable, it shall be severed without affecting the validity of the remaining provisions.

18. Governing Law:

These Terms and Conditions are governed by South African law.

19. Force Majeure:

Bullion Link (PTY) Ltd shall not be responsible for failure to perform due to causes beyond its control.

20. Costs:

Bullion Link (PTY) Ltd may recover all costs incurred in enforcing these Terms and Conditions.
